Terms & Conditions

By downloading or using the app, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. You’re not allowed to copy or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages or make derivative versions. The app itself, and all the trademarks, copyright, database rights, and other intellectual property rights related to it, still belong to Savara Tack Ltd.

Savara Tack Ltd is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.

The Take My Tack app stores and processes personal data that you have provided to us, to provide our Service. It’s your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the Take My Tack app won’t work properly or at all.

You should be aware that there are certain things that Savara Tack Ltd will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi or provided by your mobile network provider, but Savara Tack Ltd cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.

If you’re using the app outside of an area with Wi-Fi, you should remember that the terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third-party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.

Along the same lines, Savara Tack Ltd cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, Savara Tack Ltd cannot accept responsibility.

With respect to Savara Tack Ltd’s responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavor to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. Savara Tack Ltd accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.

At some point, we may wish to update the app. The app is currently available on Android & iOS – the requirements for the both systems(and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the app. Savara Tack Ltd does not promise that it will always update the app so that it is relevant to you and/or works with the Android & iOS version that you have installed on your device. However, you promise to always accept updates to the application when offered to you, We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.

Changes to This Terms and Conditions

We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page.

Take My Tack

Take My Tack is part of Savara Tack Ltd and is a marketplace app established to provide and safe and secure platform to buy and sell second-hand, list their business information in the Equine Directory and provide content in the Chat Forum.

This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from Take My Tack (the “App”).

We take data protection very seriously and understand the importance of protecting your privacy and Personal Information. “Personal Information” is information that identifies you as an individual such as your name, date of birth, email address, IP address and telephone number.

Personal information we collect
When you visit the App, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the App, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the App, and information about how you interact with the App. We refer to this automatically-collected information as “Device Information”.

We collect Device Information using the following technologies:

– “Log files” track actions occurring on the App, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.

Additionally when you make a purchase or attempt to make a purchase through the App, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number. We refer to this information as “Order Information”.

When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information.

Some information we collect and store whilst voluntarily given by yourself, may have been unintentional, such as information divulged through the use of search tools and content you interact with.

Personal Information we collect and store about you may include the following:

General identification and contact information: your name, address, email, IP address, telephone details, gender, marital status, family status, date and place of birth, physical attributes including photos

Other sensitive information: political opinions, racial or ethnic, trade union membership, religious beliefs and criminal record.

Information enabling us to provide products and services: age, location, whether or not you hold a driving licence

Information from Apps: User generated content submitted through contributing to online forums, commenting on blog posts, completing onsite forms or emailing any of our internal services teams

Professional history information available publicly: educational background, employment history, skills and experience, professional licences and affiliations, educational and professional qualifications

Marketing preferences: defined when entering a competition or prize draw, submitting a survey response of other sales/marketing promotional activity

Statistical information: aggregate statistical information about site visitors and users for internal use and for other lawful purposes such as salary comparison services. Where we utilise such information, we will do so using an anonymous format and not include any Personal Information.

What legal basis do we reply on to process your Personal Information?
The App can also process your data when it is deemed legitimate interest to do so and when these interests are not overridden by your data protection right:

Ensuring the security and integrity of our services at all times

Enabling our Websites and Apps to operate effectively

Protecting and maintaining the safety, health and welfare of our customers, employees and other individuals

Promoting, marketing and advertising our products and services and/or sending promotional communications which are relevant and tailored to individual customers

The basis for processing this information will be based on an applicable legal obligation. Other examples where the App may process your data include complying with our legal and regulatory obligations, such as preventing, investigating and detecting crime, fraud or anti-social behaviour. This may include the need to work and share this information with law enforcement agencies.

How do we use your personal information?
We use the Order Information that we collect generally to fulfil any orders placed through the App (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:
– Communicate with you;
– Screen our orders for potential risk or fraud; and
– When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
– Carry out market research and analysis, including satisfaction surveys
– Allow you to participate in contests, prize draws and similar promotions

– Personalise your experience on the App by presenting information and advertisements tailored to you

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our App (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

Sharing your personal Information
We share your Personal Information with third parties to help us use your Personal Information, as described above. Third-Party Processor

We use third party payment processor to process payments made to us. In connection with the processing of such payments, we do not retain any Personally Identifiable Information (PII) or any financial information such as credit card numbers. Rather, all such information is provided directly to our third party processor, Stripe, whose use of your personal information is governed by their privacy policy.

As a controller, we will not be legally responsible to you for any loss that you may suffer if a third-party gain unauthorised access to any information that you provide to Stripe.

As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. How can you manage or delete Personal Information?
Below are the ways in which you can take control of how we use your Personal Information:

General Information
When you register or send an enquiry through the App, you will create an account on the site, against which we will store your basic details such as name, sex and location. On future visits, when logging in to your ‘My Account’ area, it is protected by your password and may only be accessed by you. You can manage the content and information in your Account at any time, by logging in to your ‘My Account’. As part of the account creation process, you will also agree to our Terms & Conditions and can choose how we keep in contact with you. If you want to update your marketing preferences, you can do so at any time by logging into your account and updating your preferences.

Contact Details
When placing an item/product or service advertisements with the App, you can select whether or not to expose your telephone your telephone number as one of the contact methods you can be reached via. The default setting is for your number to be shown. You may however choose to remove your telephone number from being seen by customers. We do not provide your data to any third parties, beyond those explicitly detailed in this Privacy Policy and where we have a legitimate business case to do so.

You can decide to update your preferences or unsubscribe from any marketing or promotional information that we may send to you by using the below methods:

– Amending your account details by logging in to our website and opting in/out of the available communication preferences options

Analytics:

When you access our website online, we store some information about you. This is generally anonymous and used for statistical purposes. However, the App uses a specific cookie to work with Google Universal Analytics and help us to understand how logged in users interact with our site. we do this by utilising a User ID we store against every user and combining this with the Google Analytics stored information. The information we collect helps us to provide a better experience and allows us to understand how you use the App to fulfil your goals.

Deleting your Personal Information:
you can remove any of the information that the App stores about you, at any time, by logging into your account and choosing to ‘delete my account’.

Security

The App is committed to keeping your personal data safe and secure from unauthorised access to or unauthorised altercations, disclosure or destruction of information that we hold. We operate secure data networks protected by industry standard firewall and password protection. We have security measures in place to attempt to protect you to our fullest capability. To minimise potential breach or misuse, only cleared employees have access to the Personal Information that you provide us.

The App use third-party cloud service providers that provide hosting, data storage and other services pursuant to standard terms and conditions that may be non-negotiable. These providers have informed us or the general public that they apply security measures they consider adequate for the protection of information within their system, or they have a general reputation for applying such measures. However, we will not be liable (to the fullest extent permitted by law) for any damages that may result from the misuse of any information, including Personal Data, by these companies.

Location based services
In some instances we will use location information made available to us to provide you with items, products and services close to you and to improve the general experience we provide to you. In no case will we merge such information with any personally identifiable information. We will at no times be able to connect you personally in connection with the respective location. You may at any stage opt out of location tracking by updating your device settings.

Do not track
Please note that we do not alter our App’s data collection and use practices when we see a Do Not Track signal from your browser.

Your rights
If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below.

Additionally, if you are a European resident we note that we are processing your information in order to fulfil contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.

Data retention
When you place an order through the App, we will maintain your Order Information for our records unless and until you ask us to delete this information.

Changes
We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.

The Site is not intended for individuals under the age of 13.
